1. Who we are — disclosures in terms of section 43(1) of the ECT Act
1.1 It is recorded that this information is published in terms of section 43(1) of the Electronic Communications and Transactions Act 25 of 2002 (hereinafter referred to as “the ECT Act”), which obliges a supplier offering goods or services on an electronic platform to make the following available to consumers.

- Main characteristics of what we supply
- Purebred French Bulldog puppies bred at the above address, sold to private homes, collected in person, supplied with a vaccination card, microchip certificate, registration paperwork and a written sale agreement and health guarantee.
- Price
- Puppies are priced between R20 000 and R40 000, depending on registry, colour, gender and whether breeding rights are included. The exact price of a particular puppy is confirmed in writing when a litter is confirmed, before any payment is made. Transport to another province, where arranged, is an additional cost which is quoted in writing beforehand.

- Deposit, payment and cancellation terms are set out in our written sale agreement, which you receive and can read before you make any payment.
- Dispute resolution
- Please raise any complaint with us in writing at [email protected] or on WhatsApp at 083 306 5875. We will respond in writing and try to resolve it with you directly. This does not affect any right you have to approach the National Consumer Commission or any other forum in terms of the Consumer Protection Act 68 of 2008.
1.2 It is recorded that, in terms of section 43(3) of the ECT Act, a consumer who does not receive the information listed in section 43(1) may cancel the transaction within fourteen days of receiving the goods.
2. Consumer rights that apply regardless of what any agreement says
2.1 A puppy sold by a breeder to a private buyer is “goods” supplied in the ordinary course of business, and the Consumer Protection Act 68 of 2008 (hereinafter referred to as “the CPA”) accordingly applies to the sale.
2.2 In terms of section 55 of the CPA, the buyer has a right to goods that are reasonably suitable for the purpose for which they are generally intended and of good quality, and in terms of section 56 the buyer may return goods that fail that standard within six months of delivery. It is recorded that the voetstoots clause commonly used in private sales does not exclude these rights in a consumer transaction.
2.3 In terms of section 41 of the CPA, no supplier may make a false, misleading or deceptive representation about the goods, including about their registration, pedigree, health status or characteristics.
2.4 Accordingly, nothing in our sale agreement or health guarantee limits or replaces any right the buyer has in terms of the CPA; those rights operate in addition to it.
3. Privacy notice — processing of personal information
3.1 This notice is issued in terms of section 18 of the Protection of Personal Information Act 4 of 2013 (hereinafter referred to as “POPIA”).
3.2 Responsible party. Kyle Blackbeard, at the address in clause 1 above. Information Officer: Kyle Blackbeard.
3.3 What this website collects. Nothing. The waiting-list form on this site does not transmit or store anything. It assembles the words you typed into a WhatsApp message on your own device, which you then choose to send or not send. Should you not press send, we never receive it.
3.4 What we collect once you contact us. Your name, contact details, the town you live in, and what you tell us about your household and your suitability for the breed. We collect this for one purpose: to decide whether to place a puppy with you and, if we do, to perform the sale agreement.
3.5 Who we share it with. Nobody, save that where a puppy is placed with you we must supply your name and address to the microchip database and to the applicable registry in order to register the transfer. We do not sell, rent or trade contact details, and we do not add anyone to a mailing list without being asked.
3.6 How long we keep it. Enquiries that do not result in a placement are deleted within twelve months. Records relating to a puppy actually placed are kept for the life of that dog, because we may need them if the dog needs to come back to us.
3.7 Your rights. You may ask what we hold about you, ask us to correct it, or ask us to delete it, by writing to the email address in clause 1. Should you be dissatisfied, you may complain to the Information Regulator (South Africa) at [email protected].
4. Terms of use of this website
4.1 The content of this site is published for information. It is not veterinary advice, and it does not constitute an offer capable of acceptance. A sale is concluded only on signature of a written sale agreement.
4.2 Photographs of previous litters are illustrative of the kennel and are not a representation as to the appearance, colour, size or conformation of any future puppy.
4.3 Should any provision of these terms be found unenforceable, the remaining provisions shall continue to apply.
4.4 These terms are governed by the law of the Republic of South Africa.
